Welcome to Gibby_Visuals ("Company," "we," "us," or "our"). By accessing or using our website (the "Site") and our photography services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

1. Services

We provide professional photography services, including but not limited to automotive, portrait, event, and commercial photography. Specific service details, pricing, and availability are subject to change without prior notice.

2. Booking & Payment

• A deposit may be required to secure a booking. Deposits are non-refundable unless otherwise stated.

• Full payment is due before or upon completion of the photoshoot unless otherwise agreed upon.

• Payments are accepted via e-transfer, credit card, cash, or cheque.

• Any additional costs incurred during the shoot (e.g., travel, permits, venue fees) will be the responsibility of the client.

3. Cancellations & Rescheduling

• Clients must provide at least 48 hours' notice for cancellations or rescheduling.

• Cancellations with less than 48 hours’ notice may be subject to a cancellation fee.

• We reserve the right to reschedule or cancel a session due to unforeseen circumstances, such as weather conditions or equipment failure.

4. Intellectual Property & Usage Rights

• All photographs remain the intellectual property of Gibby_Visuals unless explicitly transferred in writing.

• Clients receive a license to use the photos for personal or commercial use, depending on the agreed terms.

• Unauthorized reproduction, editing, or resale of images without prior consent is strictly prohibited.

• We reserve the right to use images for promotional purposes unless the client requests otherwise in writing.

5. Delivery & Editing

• Standard turnaround time for edited photos is 3-4 Business Days from the date of the shoot.

• We retain the right to edit and adjust photos at our discretion to maintain artistic integrity.

• Raw, unedited images are not provided unless explicitly agreed upon in advance.

6. Liability & Disclaimer

• We are not responsible for any personal injury, property damage, or unforeseen circumstances during the shoot.

• While we take precautions to back up files, we are not liable for loss or corruption of images due to technical failures.

• We do not guarantee specific results or outcomes from any photography session.

7. Privacy Policy

• We collect personal information only for booking and service fulfillment purposes.

• Client information is never shared with third parties without consent.

8. Modifications to Terms

We reserve the right to update or modify these Terms at any time without prior notice. Continued use of our Services after modifications constitutes acceptance of the revised Terms.

9. Governing Law

These Terms are governed by the laws of the Province of British Columbia, Canada. Any disputes arising from these Terms shall be resolved in the courts of Kelowna, British Columbia.
